These Terms and Conditions (“Terms”) apply to all services provided by Modish Web Solutions (“we”, “us”, “our”) to you (“the client”), and to your use of modishwebsolutions.com. By paying a deposit, accepting a proposal or using our services, you agree to these Terms. Please also read our Privacy Policy.

Quick summary: we agree the scope and price in writing before work starts, you pay 50% to start and 50% before final delivery, and if we do not complete the work we agreed, you are covered by our 30-day money-back guarantee.

1. Our services

We provide logo and brand identity, branding, website design and development (including WordPress, Webflow, Shopify and GoHighLevel), LMS development, SEO, digital marketing, and automation, CRM and funnel services. The exact deliverables, timeline and price for your project are set out in your written quote, proposal or order (the “Agreement”). If anything in the Agreement differs from these Terms, the Agreement applies.

2. Quotes and pricing

All prices are in US dollars (USD) unless your quote says otherwise.
“From” prices on our Packages page are starting prices for the smallest scope. Your final price is confirmed in writing before any work starts.
Quotes are valid for 30 days.
Prices do not include third-party costs such as domain names, hosting, premium plugins or themes, stock images, software subscriptions (for example GoHighLevel), SMS or email sending fees, or advertising spend. These are paid directly to the provider or billed to you at cost.

3. Payment terms

One-time projects: 50% deposit to start, and 50% before final delivery or launch.
Monthly plans: billed monthly in advance. SEO and Digital Marketing plans have a 3-month minimum term, and Skyline has a 6-month minimum term. After the minimum term you can cancel with 30 days’ written notice.
Work starts once the deposit is received. Late payments may pause the project and move the delivery date.
Orders placed through a freelance marketplace (such as Fiverr) are paid and refunded through that platform and follow its rules, in addition to these Terms.

4. Your responsibilities

Provide content, images, logins and feedback within the timeframes we agree. Delays on your side move the delivery date.
Make sure you own or have permission to use any content, logos, images or data you give us.
Do not ask us to build anything illegal, misleading, harmful, or that infringes someone else’s rights.
Keep your own backups of important content and accounts you control.

5. Revisions and changes in scope

Each plan or proposal lists the number of revision rounds included. Extra revisions, new features or changes to the agreed scope are quoted separately, and we will always tell you the cost before any extra work is charged.

6. Timelines

We give estimated timelines in your Agreement and work hard to meet them. Timelines depend on receiving your content and feedback on time. We will keep you updated if anything changes.

7. 30-day money-back guarantee and refund policy

We stand behind our work. If we do not complete and deliver the work agreed in your Agreement, you can ask for your money back.

When you are eligible for a refund

Full refund: if we do not deliver the agreed work, you can request a full refund of the amount you paid for that work.
Partial refund: if we deliver some milestones but not others, we refund the amount paid for the milestones we did not deliver.
Time limit: request your refund within 30 days of your payment or of the agreed delivery date, whichever is later.
Fair use: the guarantee applies to clients who have followed these Terms, including providing the content, access and feedback we need on time.

When the guarantee does not apply

Work that has been delivered as agreed and approved by you, or that is live and in use.
Delays caused by the client, such as missing content, access or feedback for more than 14 days after we ask for it.
Changes of mind or new requirements outside the agreed scope.
Third-party costs we paid on your behalf (domains, hosting, plugins, software subscriptions, stock assets, ad spend) and non-refundable payment processing fees.
Monthly services for months that have already been carried out (for example SEO work, ad management or support already provided).
Results that depend on third parties, such as Google rankings, ad platform approvals or sales numbers. We do not guarantee specific rankings or revenue.
Breach of these Terms, including requests for illegal or harmful work, abusive behaviour, or opening a chargeback while a refund request is being handled.

Returns

Because our services are digital and custom-made, they cannot be “returned” like physical products. Instead, this refund policy applies. If you receive a refund for work, the licence to use that work ends and it must be removed from use.

How to request a refund

Email info@modishwebsolutions.com with your name, invoice or order number, and the reason for your request.
We reply within 2 business days and may suggest a fix or new delivery date first, if you would like that.
Approved refunds are paid within 10 business days to the original payment method.

8. Ownership and intellectual property

Once you have paid in full, you own the final deliverables we create specifically for you, such as your logo files, designs and website content.
Third-party items (themes, plugins, fonts, stock images, software) remain owned by their creators and are used under their own licences.
We keep ownership of our own tools, templates, methods and code that are not specific to your project, and give you a licence to use them as part of your deliverables.
Unless you ask us not to, we may show the finished work in our portfolio and marketing.

9. Hosting, accounts and third-party platforms

Where possible, websites, domains and software accounts are set up in your name so you stay in control. We are not responsible for outages, price changes, policy changes or account suspensions by third-party providers such as hosting companies, Google, Meta or GoHighLevel.

10. Confidentiality

We keep your business information, logins and private materials confidential and only use them to deliver your services. We ask you to keep our proposals and pricing confidential as well.

11. Limitation of liability

We provide our services with reasonable skill and care. To the maximum extent allowed by law, we are not liable for indirect or consequential losses, such as lost profits, lost data or lost business. Our total liability for any claim is limited to the amount you paid us for the service that the claim relates to. Nothing in these Terms limits any rights you have under consumer laws that cannot be excluded.

12. Cancellation and termination

You may cancel a one-time project at any time by email. Work completed up to that point is charged, and any unused amount is refunded under section 7.
Monthly plans can be cancelled after the minimum term with 30 days’ written notice.
We may end the Agreement if you seriously breach these Terms or do not pay, after giving you written notice and a chance to fix the issue.

13. Use of this website

You may use this Website for lawful purposes only. Do not try to hack, overload, copy or misuse it. Content on this Website, including text, graphics and logos, belongs to Modish Web Solutions unless stated otherwise and may not be copied without permission. Blog articles are general information and not professional legal, financial or technical advice for your specific situation.

14. Governing law and disputes

These Terms are governed by the laws of Pakistan. If a dispute arises, we will first try to resolve it in good faith by email or a call. If it cannot be resolved, it will be handled by the courts of Pakistan, unless the law of your country gives you the right to use your local courts.

15. Changes to these terms and conditions

We may update these Terms from time to time. The version in force when you accept your Agreement applies to that project. The “Last updated” date at the top shows the latest version.
